Purchasing property in Mexico is a straightforward and rewarding experience.
Most foreign investors find the process to be highly professional, transparent, and pleasant β€” especially when guided by experienced professionals.

The most important step is to ensure you are represented by qualified experts, such as a reputable real estate agent and a trusted attorney. In Mexico, it’s always advisable to request referrals to find the most capable professionals to represent your interests.

How Can a Foreigner Purchase Property in Mexico?

Foreign buyers can acquire property located within 100 kilometers (62 miles) of any border or 50 kilometers (31 miles) of the coastline through a Bank Trust, known as a Fideicomiso.

Bank Trust (Fideicomiso)

For All Residential and Tourism Properties

A Fideicomiso is a trust agreement established with a Mexican bank to hold the title of your property. Both you and the bank are listed in the title deed, ensuring full ownership rights and legal protection.

This system allows foreign buyers to enjoy all the rights and benefits of direct ownership while remaining in full compliance with Mexican law.

Advantages of a Bank Trust

  • Ownership is held in perpetuity (forever).

  • The trust is valid for 50 years and can be renewed indefinitely by you or your heirs.

  • You can transfer your rights to another foreign buyer.

  • One trust can include multiple properties under the same deed.

  • You may rent, sell, or remodel your property freely.

  • Your heirs can inherit the rights to the fideicomiso, bypassing probate in the event of your passing.

  • There are potential tax benefits regarding capital gains upon sale.

  • The trust is simple to maintain, requiring only an annual fee to the bank.
